Gensler emphasized that the digital nature of cryptocurrencies does not change how they should be regulated, stating that when investors put their money at risk, the economic realities of the investment matter, regardless of the underlying technology. He also noted that, according to his view, only a small number of tokens, potentially including Bitcoin, might qualify as "crypto non-security tokens," while the status of others, like Ethereum, has been a subject of ongoing debate and investigation within the SEC. Gensler stepped down from his role as SEC Chair on January 20, 2025, with his departure occurring amid a change in the U.S. presidential administration.
